Michigan was one of the first states to adopt a no-fault divorce system. Though there are no fault-based grounds for divorce in Michigan, fault is considered in some aspects of the divorce proceedings. For example, spousal support judgments can take into account the contributions each spouse made to the ending of the marriage.
If that sounds confusing, don’t worry. This article will walk you through how to file for a Michigan divorce and cover all the rules and forms and considerations that go into ending a marriage.
Michigan requires that the spouse filing for divorce must have lived in the state for 180 days before filing and lived in the county for at least the last 10 days. However, the 10 day requirement is waived if the defendant was born in or is a citizen of another country, the parties have a minor child or children and the child is at risk of being taken out of the U.S. and held in another country by the defendant. If the residency requirements are met, filing is relatively straightforward. Michigan is a no-fault state, so neither party needs to allege or prove any cause for the ending of the marriage besides a breakdown of the marriage. Specifically, Michigan’s cause for divorce is “there has been a breakdown of the marriage relationship to the extent that the objects of matrimony have been destroyed and there remains no reasonable likelihood that the marriage can be preserved.”
